Hoffman Pleads Guilty to Animal Cruelty

Just before the trial was scheduled to begin today Hubert Hoffman plead guilty to his charges and was sentenced to three years probation. His terms of probation are that he not be around animals during probation and he attend mandantory psychologial counseling. The Moonlight Kitten was released to the Cat Rescue House for adoption. We want to thank the San Diego County District Attorney for pursuing this case and rescuing the MoonLight Kitten from sure serious injury or death. We want to really thank all the people that called, e-mailed and FAXed the DA in support of this kitten.

VISTA, Calif. -- A 69-year-old man accused of trying to drown a kitten at Moonlight Beach was scheduled to appear in a Vista courtroom Tuesday to stand trial on an animal cruelty charge.
Hubert Hoffman is charged with misdemeanor animal cruelty in connection with an incident that occurred at the Encinitas beach on Sept. 3.

Hoffman allegedly pushed a kitten under the water and held it down with a piece of cloth, prompting the kitten to scratch away at the defendant's arm.

He reportedly told onlookers who tried to intervene, "She loves to swim; mind your own business."
Someone called 911 as a crowd gathered around Hoffman, preventing him from leaving until sheriff's deputies arrived and took him into custody, The San Diego Union-Tribune reported.
"His story was that he was just trying to give his cat a bath," Encinitas lifeguard captain Larry Giles told the newspaper.

A Web site was created to advocate for the kitten, www.savemoonlightkitten.com. The site encouraged residents to ask the San Diego County District Attorney's Office to prosecute Hoffman.

Thank you to all who have responded to our plea to help this kitten. It is heartwarming to know so many people are willing to help a small defenseless creature.

We must now wait for our court system to take it's course and hopefully release the kitten for adoption to a loving home.

There will be no more updates to this website until Oct. 13, 2009 when the defendant has a Readiness Conference.

At the Readiness Conference, the judge, prosecutor, and defense lawyer will try to enter into a plea bargain. If the defendant rejects the plea bargain, the case goes to a jury trial.
